What Texas law asks of a site that collects enquiries

Texas has a comprehensive consumer privacy law. The Texas Data Privacy and Security Act, which practitioners call TDPSA, took effect on 1 July 2024. It reaches a business at any business processing personal data that is not a federally defined small business.

Texas is one of twelve states whose law requires a business to honour a universal opt-out signal, the browser-level setting usually implemented as Global Privacy Control. That is a build requirement rather than a policy one. A cookie banner that only records a click is not enough: the site has to read the signal the browser sends and treat it as an opt-out before the visitor touches anything.

  • A consent layer that reads the opt-out signal on load, not one that waits for a click on a banner
  • A route for a resident to make a rights request, staffed by someone who will actually answer it
  • A privacy notice that describes what the site collects in terms a reader recognises, rather than a template naming trackers you do not run
  • Forms that record what was consented to at the moment of submission, so the record exists if it is ever asked for

What you are competing against in Houston search

If the project involves a catalogue, a listings set or a page per location, those numbers decide the architecture, and we write them into the brief with the date attached rather than quoting a figure from an article.
